  • I just was served a summons, what do I do?
    • If you were just served a summons and related petition by a process server you have twenty (20) days to answer the petition. Not twenty (20) business days, twenty (20) actual days to include weekends.
    • If you do not answer the petition within twenty (20) days, you could have a clerical and/or judicial default entered against you.
      • What is a default?
        • A default must be motioned for by the opposing side and is basically an admission of everything that was listed in the petition.
    • What do I do if the other parent will not allow me to see my child?
      • First, are you married?
        • If yes, paternity is inferred by the state, meaning you have immediate rights to the child.
        • If no, you must establish paternity before you have parental rights to the child.
      • Second, you must motion the court to notify them of the issue.
      • The court may require you to establish paternity before you can assert parental rights.
